 1.⁠ ⁠Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the website operated by The Nutra Company, its affiliates and subsidiaries (collectively “TNC”, “we”, “us” or “our”) and the purchase of its products (the “Products”) by you the consumer (“you”, “your”). By placing an order or using the website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the website or purchase any Products.

 2.⁠ ⁠Eligibility
You represent and warrant that you are at least 18 years of age, have legal capacity to enter into these Terms, and are not prohibited from receiving or purchasing food products under applicable laws of India or your place of residence.

 3.⁠ ⁠Products and Descriptions
3.1 TNC offers functional coffee blends (“Energy”, “Focus”, “Beauty”, “Slim”) each in single-serve 10 g sachets, formulated with specified ingredients.
3.2 While we endeavour to ensure product descriptions and images are accurate, slight variations in appearance or packaging may occur.
3.3 The stated ingredients serve functional wellness purposes but do not constitute medical advice. Please consult a healthcare professional before use if you are pregnant, nursing, taking medication, or have a medical condition.

 4.⁠ ⁠Pricing and Payment
4.1 All prices displayed on the website are in Indian Rupees (INR), inclusive of applicable GST unless stated otherwise.
4.2 Payment must be made in full at time of order via the authorised payment methods offered on the website.
4.3 We reserve the right to change prices at any time without prior notice. Any price changes will not affect orders already accepted by us.

 5.⁠ ⁠Order Acceptance and Cancellation
5.1 Your order constitutes an offer to purchase. We may accept or reject your order at our sole discretion. No contract is formed until we send you an order confirmation email.
5.2 We may cancel or refuse to fulfil an order if the Product is out of stock, there is an error in pricing or description, or there are issues with payment.
5.3 You may cancel an order prior to dispatch by emailing our support team. Once a Product has been dispatched, cancellation will be treated as a return subject to clause 7.

 6.⁠ ⁠Shipping and Delivery
6.1 We ship to locations within India via chosen courier service. Delivery times are estimates only and may vary by location.
6.2 Risk of loss and title to the Products pass to you when we deliver them to the carrier.
6.3 Any damages or shortages must be reported within 24 hours of receipt by emailing support with photographs and order details.

 7.⁠ ⁠Returns and Refunds
7.1 If you receive a defective, damaged or incorrect Product, you may request a return within 7 days of delivery by contacting our support team. We will guide you through the process.
7.2 Returns are accepted only for Products returned in saleable condition, unused and in original packaging. Custodial costs (shipping, handling) are not refundable except where the defect lies with TNC.
7.3 Refunds, where applicable, will be processed within 10-15 business days following our inspection and approval. Opened individual sachets are not eligible for return unless part of a manufacturing defect or mis-shipment.
7.4 Customised orders or free promotional items are excluded from return rights.

 8.⁠ ⁠Use of Website and Intellectual Property
8.1 All content on the website (text, images, logos, graphics) is the property of TNC or its licensors and is protected by intellectual property laws.
8.2 You may not copy, reproduce, distribute or publicly display any content without our express written consent.
8.3 You retain rights to any content you submit (e-g. reviews), but by submitting you grant TNC a non-exclusive, worldwide, perpetual licence to use, reproduce and modify such content in connection with our business.

 9.⁠ ⁠Disclaimers and Limitation of Liability
9.1 The Products are produced in GMP-certified facilities and designed for wellness purposes only. They are not intended to diagnose, treat, cure or prevent any disease.
9.2 To the fullest extent permitted by law, TNC disclaims all warranties (whether express or implied, including merchantability or fitness for purpose).
9.3 TNC’s total liability arising out of any order or use of Product shall not exceed the amount you paid for that particular Product. We shall not be liable for any incidental, indirect, special or consequential damages.

10.⁠ ⁠Indemnification
You agree to indemnify and hold harmless TNC, our officers, directors, employees and agents from any claim, loss, liability or expense (including legal fees) arising from your breach of these Terms or your use of the Products or website contrary to these Terms.

11.⁠ ⁠Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra.

12.⁠ ⁠Amendments
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Continued use of the website after changes means you accept the updated Terms.

13.⁠ ⁠Miscellaneous
13.1 If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions will remain in full force.
13.2 These Terms, together with our Privacy Policy, constitute the entire agreement between you and TNC regarding use of the website and purchase of Products and supersede any prior agreements.
13.3 No waiver by TNC of any breach shall be deemed a waiver of any subsequent breach.
